PAYBACK Competition Terms & Conditions

Before participating in the “IrishJobs.ie Payback” promotion to win 40,000 Euro (the “promotion”), please read through and accept these terms and conditions (the “Promotion Terms “). If a person enters the promotion (“you” or the “entrant”) it, he or she must accept the Promotion Terms. Do not enter the promotion if you do not agree to the Promotion Terms.

  1. The promoter is Saongroup Limited, a company incorporated in Ireland with company registration number 260762 and a registered office at Orchard House, Clonskeagh Square, Clonskeagh, Dublin 14 (the “promotor”, “IrishJobs.ie”, ”we” or “us”).
  2. The prize for winning the promotion is ‚¬40,000 (the “Prize”). There is no alternative to the Prize, which if not accepted by the Winner of the Prize determined in accordance with the Promotion Terms, shall be deemed withdrawn by us. The Prize is non-transferable.
  3. To enter the promotion an entrant must submit a completed registration entry form by completing an official entry form online at www.irishjobs.ie/payback no later than Tuesday, November 7th, 2017 (the “Closing Date”).
  4. 4. All fully paid customers of IrishJobs.ie are eligible to enter. In the case of Recruitment Agencies, only entries based on internal hires of the Recruitment Agencies own employees (as Employe Entrants) made for that specific Recruitment Agency. All entries will be accepted on the condition that the entrant permits the use of the hiring company’s permission to use their company name and logo in the promotion and marketing of the promotion.
  5. Entrants who successfully complete the Entry Form and correctly answer the questions will be shortlisted to be judged by us.
  6. An overall winner will then be chosen by IrishJobs.ie from the correct entries based on their answer of the ‘Test of Skill’ question (the “Entry Form”).
  7. From the Entry Form the promoter will choose a winner of the Prize which the promoter believes, in its absolute discretion, is the best entry. Entrants agree that the running of the promotion, and its manner and format, is at the sole discretion of the promoter and will determine the winner of the Prize (the “Winner”).
  8. The entrant chosen as the Winner of the Prize by the promoter under clause 7 must collect the Prize at a date and time nominated by the promoter. The Winner must nominate a senior person within the Winner’s business to make his or her own way to the official Prize awarding event, at the location, date and time as advised to the Winner by the promoter, and any associated costs of travelling to the Prize collection point incurred by the Winner are the sole responsibility of the Winner. The Prize will be paid by us by BACS transfer to a bank account nominated by the Winner. If the Prize is unclaimed by this time, it will lapse, the Winner does not have any right to the Prize and the promoter reserves the right to deal with the unclaimed Prize as it sees fit. The Winner assumes responsibility for the Prize upon the Winner receiving the Prize at collection and is solely responsible for any tax payable in connection with the Winner’s receipt of the Prize.
  9. The Winner’s details (Company name/county) will be made available on request to those writing to IrishJobs.ie, Orchard House, Clonskeagh Square, Clonskeagh, Dublin 14 within ten weeks after the Closing Date, enclosing a stamped self-addressed envelope.
  10. One promotion entry per hire made by each entrant as a result of the entrant advertising the job vacancy for any length of time on the promoter’s website www.irishjobs.ie from 1 January, 2017 to 12 noon on 31 October, 2017 will be accepted by the promoter and multiple entries are allowed from one entrant corresponding with the number of such hires (up to a maximum of 30 entries) per entrant.
  11. The promoter will not accept promotion entries: (a) received by post; (b) delivered to IrishJobs offices; (c) that are incomplete; or (d) that are electronic entries but are not made through the official website page(s) of the promoter dedicated to the promotion at www.irishjobs.ie/PayBack. The promoter does not accept responsibility for entries that are lost, delayed, corrupted, misdirected, incomplete or otherwise excluded from the promotion for whatever reason. Promotion entries are the property of the promoter. Any entries may be rejected by the promoter or excluded from the promotion, without reason or notice, at its sole discretion. All instructions to entrants on an entry form issued by the promoter form part of the Promotion Terms.
  12. To be eligible to participate in the promotion an entrant (an “entrant”) must have been a fully paid customer of the promoter in the period [1 January 2017 to 12 noon on 31 October, 2017, where a living person (e.g. sole trader) be aged 18 years or over and must not be an employee of the promoter, a family member of an employee of the promoter, an agent of the promoter, or anyone professionally connected with the promotion. The promoter reserves the right, at any time, to verify the eligibility and the identity of entrants, and to require proof of age of entrants who are living individuals. The promoter may require such information as it considers reasonably desirable for the purpose of verifying the eligibility of an entry, and the prize and/or participation in the promotion may be withheld until and unless the promoter is satisfied with the verification or information.
  13. When the entrant gives information on hires made to the promoter for the purposes of the Entry Form the entrant warrants that this person (the “Entrant Hire”) was hired by the entrant as a direct result of use of the promoter’s website www.irishjobs.ie and that all information given in the Entry Form or otherwise to us is true, complete and accurate in all respects. The entrant will ensure that it, he or she is entitled to supply the Entrant Hire details and to authorise the use of the Company logo and name for the purposes of the promotion and shall ensure that the hire complies with the Promotion Terms and that the company will participate in all promoter marketing and advertising activities without cost, if or when requested by the promoter to do so.
  14. By entering the promotion, an entrant is consenting for the promoter to use its, his or her name and email address to send it’s, him or her details in its marketing and publicity in the future in relation to its products or future promotions.
  15. As a condition of entry arising from this promotion all entrants agree to comply with these Promotion Terms and to participate in unpaid publicity in relation to the promoter’s services, including (but not limited to) in the publishing in any media or information submitted as their Entry Form, including the entrant company logo.
  16. Unless otherwise stated, promotion entries will not be returned to the Entrant.
  17. In respect of copyright and other intellectual property rights in the promotion, your entry into the promotion, the Entry Form, and your involvement and that of the Entrant Employee in the promotion (including, without limitation, all interviews, pictures, audio, audio-visual, whether your and/or your Entrant Employee’s appearance is featured or incidental) in all media and technology (the “Works”), you hereby agree, at the promoter’s request, to assign to the promoter the entire such copyright and other intellectual property rights (including without limitation where such Works are not in existence at the date of the Promotion Terms, by way of present assignment of future copyright) and you agree to do all such acts as may be reasonably requested of you by the promoter to effect the assignment under this clause and you agree that any assignment shall include the right for the promoter to alter, edit, compile, amend or otherwise adapt such Works and/or use such Works in conjunction with any other material to use, distribute and/or broadcast such Works in all media and all formats (including transmission by way of analogue transmission, digital audio broadcasting, internet, satellite, television, film, cable or telephony) and the right to sub-license such rights to any other persons, in each case for such purposes as the promoter may in its absolute discretion determine.
  18. You warrant that any information which you submit to the promoter will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libelous, defamatory, obscene, indecent, harassing or threatening. We reserve the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove such information.
  19. By entering the promotion and submitting any material or Works you warrant to the promoter that: (a) you own or are licensed in respect of the Works submitted as part of the promotion conditions and that you have the right, power and authority to grant the rights set out in these Promotion Terms;(b) the promoter is free and able to use the Works in accordance with and in the manner set out in any relevant terms; and (c) you agree to waive any moral rights you may have in the Works and have obtained a waiver or all applicable moral rights in the Works (including from an Entrant Employee) and further have obtained all consents and permissions in respect of the Works; (d) the Works do not violate any applicable law or regulation (including any laws regarding anti-discrimination or false advertising); (e) the Works are not defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) the Works are not obscene or pornographic; and the Works do not, to the best of the your knowledge, contain any viruses or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  20. You must ensure that any person or persons whose image has been used in the relevant Works (including an Entrant Employee) has given valid consent for the use of their image or has waived any rights they may have in the images, videos or other media submitted. Failure to adequately demonstrate this consent to the satisfaction of the promoter may result in your disqualification from the promotion and forfeiture of any Prize.
  21. For the avoidance of doubt, all rights in the name and title of the promotion and the format rights for the promotion will vest exclusively in the promoter for its own use (in its absolute discretion).
  22. At any time, an entrant can make a written request to the promoter at IrishJobs Orchard House, Clonskeagh Square, Clonskeagh, Dublin 14, Ireland to have access to information that the promoter holds about him or her, or may inform the promoter of any changes in his or her personal data, by contacting the promoter at IrishJobs Orchard House, Clonskeagh Square, Clonskeagh, Dublin 14, Ireland.
  23. Each entrant acknowledges and agrees that no form of cheating will be tolerated. Any persons found or suspected of cheating, as determined in the sole and absolute discretion of the promoter, may be immediately disqualified from the promotion by the promoter without notice. Cheating includes, but is not limited to, tampering, hacking of a website, entering the promotion without meeting the eligibility requirements, using any automated software or device to gain an advantage during the promotion, exploiting any software bugs, use of the promotion beyond the defined rules of the promotion, attempting to disable or overwhelm any of the promoter’s websites, attempts to disrupt any portion of the promotion, including, but not limited to, allowing somebody else use personal information or tampering with the entry process.
  24. The promotor will not accept any responsibility whatsoever for any technical failure or malfunction or any other problem in any network, system, server, provider, or otherwise which may result in entries being lost or not properly registered or recorded and contestants hereby waive any claim whatsoever for any losses, costs, damages and expenses arising from any such problems.
  25. Any provision of these the Promotion Terms (or part of a provision) found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions will remain in force.
  26. An entrant acknowledges and agrees that all disputes in relation to the promotion shall be determined in the sole and absolute discretion of the promoter, and that such a decision shall be final and binding and no correspondence will be entered into.
  27. All other conditions, warranties or other terms which might have effect between the parties or be implied or incorporated into these Promotion Terms or any collateral contract, whether by statute, common law or otherwise, are hereby excluded, including the implied conditions, warranties or other terms as to satisfactory quality, fitness for purpose or the use of reasonable skill and care.
  28. You agree to co-operate with and comply with all reasonable requests of the promoter in connection with the promotion and these Promotion Terms.
  29. Other than for death or personal injury arising from the negligence of the promoter, to the extent permitted by law, the promoter shall not be liable for any loss, damage or consequential damage of any nature in contract, tort (including negligence) or otherwise caused by the acceptance of the terms and conditions, entry, or in connection with the promotion or Prize.
  30. The promoter reserves the right to disqualify any entry or entrant or to amend or waive any of the Promotion Terms, without giving notice to any or all entrants. The promoter reserves the right to cancel, suspend or amend the promotion, including (but not limited to) in the event of any unforeseen circumstances arising which are beyond its reasonable control without giving prior notice and without liability to any entrant(s) (including the Winner).
  31. These terms and conditions shall be governed by Irish law and the courts of the Republic of Ireland shall have exclusive jurisdiction.
